Welcome to Tharsos Press. These Terms of Use explain the rules for using our website and the packages, courses, and services we offer through it. We have tried to write them in plain English so they are easy to understand. Please read them carefully, because they form a binding agreement between you and us.

If you have a question about anything here, reach out to us at [email protected]. We are happy to help.

1. Acceptance of These Terms

These Terms of Use (the "Terms") apply to your use of tharsospress.com and any related pages, forms, author portal, online course, and communications that link to these Terms (together, the "Site"). By accessing or using the Site, submitting a form, creating an account, or purchasing any package, course, or service, you agree to these Terms and to our Privacy Policy, which explains how we handle your personal information.

If you do not agree to these Terms, please do not use the Site.

If you use the Site on behalf of a business, ministry, or other organization, you confirm that you have authority to accept these Terms for that organization, and "you" includes that organization.

2. Who We Are

The Site is operated by Courageous Patriot Media, LLC, a Wyoming limited liability company doing business as Tharsos Press ("Tharsos Press," "we," "us," or "our"). We have an office in Pennsylvania. Our mailing address is 55 New St., Box 7 Suite I-3 Ephrata, PA 17522.

Tharsos Press is an imprint publisher. Authors publish their books under the Tharsos Press imprint, and we provide professional publishing services for a flat fee. We sometimes describe our model as imprint publishing or decentralized publishing.

3. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Site or purchase anything from us. The Site is intended for adults in the United States. By using the Site, you confirm that you meet these requirements.

4. Our Services and Separate Agreements

We offer packages, courses, and services, which may include editing, design, production, publishing under our imprint, marketing support, ghostwriting for some packages, and a do-it-yourself online course. Descriptions on the Site are general summaries and may change.

Publishing Services Agreement. Specific terms for our publishing services, including scope of work, deliverables, timelines, fees, payment schedules, ownership details, and any buyout options, are governed by a separate written Publishing Services Agreement between you and Tharsos Press. If there is a conflict between these Terms and your Publishing Services Agreement, the Publishing Services Agreement controls.

Rights and royalties, in brief. As a general summary only: authors keep the copyright in their work; authors keep 100% of their royalties; retailers and distributors, such as Amazon and Ingram, pay royalties to authors directly; and Tharsos Press does not take a share of royalties. Tharsos Press holds the ISBN and the cover art unless the author purchases them as provided in the Publishing Services Agreement. Your Publishing Services Agreement controls on all of these points.

Acceptance of projects. Submitting a form or booking a call does not create a client relationship. We decide in our discretion whether to accept a project, and no project begins until a Publishing Services Agreement is signed and any required payment is received.

5. Accounts and the Author Portal

Some features of the Site, such as the author portal or the online course, require an account. When you create an account, you agree to:

·       provide accurate, current, and complete information and keep it up to date;

·       keep your login credentials confidential and not share your account with anyone else; and

·       notify us promptly at [email protected] if you believe your account has been accessed without permission.

You are responsible for activity under your account. We may suspend or close an account that has been compromised or used in violation of these Terms.

6. Payments, Fees, and Refunds

Pricing. Prices for our packages, courses, and services are shown on the Site, in a proposal, or on your invoice. We may change our prices at any time, but a price change will not affect an order we have already accepted or a signed Publishing Services Agreement.

Payment processing. Payments are processed by a third-party payment processor through our website and invoicing platform. By making a payment, you authorize us and our payment processor to charge the payment method you provide for the amounts shown. Tharsos Press does not store full card numbers. Your use of the payment processor may also be subject to its own terms and privacy policy.

Payment plans. If you are on a payment plan, you authorize us to charge your payment method on the agreed schedule. If a payment fails, we may pause work or access until the balance is paid, as described in your invoice or agreement.

Refunds. Refunds, cancellations, and chargebacks are governed by your invoice, your Publishing Services Agreement, or the terms presented at checkout, as applicable.

Billing questions. If you believe you were charged in error, please contact us at [email protected] before disputing the charge with your bank.

7. Prep Course License

When you purchase our do-it-yourself course, Prep, or any other course or digital resource, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the course materials for your own personal or internal business use, for the access period stated at purchase (e.g. lifetime or 12 months).

You may not share your login, resell, redistribute, publicly post, record, reproduce, or create derivative courses or products from the course materials, or use them to train others for a fee, without our written permission. Purchasing a course does not include publishing services, publication under the Tharsos Press imprint, or individual coaching unless expressly stated at checkout. We may revoke your license if you violate these Terms.

8. Our Intellectual Property

The Site and its content, including text, graphics, logos, images, videos, course materials, templates, checklists, page designs, and software, are owned by Tharsos Press or our licensors and are protected by copyright, trademark, and other laws. The names "Tharsos Press" and "Tharsos," our logos, and related marks are our trademarks. You may not use them without our prior written permission.

You may view and print pages from the Site for personal, non-commercial use, keeping all notices intact. Any other use requires our written consent.

9. Your Submissions and Author Materials

What you submit. You may send us information and materials through the Site, forms, email, the author portal, or calls. This can include your book idea, outline, manuscript, drafts, images, business information, and feedback (together, "Submissions").

You keep ownership. You keep all ownership rights you have in your Submissions. We do not claim ownership of your manuscript or book idea.

License to evaluate and deliver services. You grant Tharsos Press, and the team members and contractors who work with us, a limited, non-exclusive, royalty-free license to access, copy, store, and review your Submissions only as needed to evaluate whether we are a good fit, respond to you, and, if we work together, deliver the services you purchase. Any broader rights needed to publish, distribute, or market your book will be set out in your Publishing Services Agreement.

Confidentiality. We treat manuscripts and author materials as confidential. We do not use them for any purpose other than evaluating and delivering our services, and we do not use them to train artificial intelligence models. More detail is in our Privacy Policy.

Your promises about Submissions. You confirm that you own or have the necessary rights to your Submissions, and that they do not infringe anyone else's rights or violate any law. Please keep your own copies of everything you send us.

Ideas and similar works. We work with many authors, and we may receive or develop ideas similar to yours. Except for our confidentiality commitments, receiving your Submission does not limit our ability to work with other authors on similar topics.

Feedback. We may use any suggestions you send us without obligation to you.

10. Acceptable Use

You agree not to:

·       use the Site for any unlawful, fraudulent, or harmful purpose;

·       submit false information or impersonate any person or organization;

·       upload content that infringes someone else's intellectual property or privacy rights, or that is defamatory, obscene, or harassing;

·       upload malware or attempt to gain unauthorized access to the Site, other accounts, or our systems;

·       scrape, crawl, or harvest data from the Site using automated means without our written permission;

·       copy, resell, or commercially exploit any part of the Site or course materials except as allowed in these Terms;

·       interfere with the Site's operation or use it to send spam.

11. Testimonials, Examples, and No Guarantee of Results

The Site may include testimonials, case studies, author stories, sales figures, and other examples. These reflect the real experiences of specific individuals, but they are not typical and are not a promise that you will achieve similar results. Results vary based on many factors, including your subject matter, audience, platform, effort, market conditions, and timing.

References to the experiences or results of any individual, including Dr. Steve Turley or other authors associated with Tharsos Press, reflect that person's unique circumstances. They are not typical and are not a guarantee of what you will experience.

We do not guarantee sales, revenue, royalties, reviews, media coverage, speaking opportunities, business growth, or bestseller status of any kind. Any marketing support we or a marketing partner provide is offered as described in your Publishing Services Agreement, and its outcome cannot be guaranteed. Nothing on the Site is legal, financial, tax, or investment advice.

12. Communications

By submitting your contact information, you agree that we may contact you by email about your inquiry, account, and services. You agree that notices, agreements, and other communications we provide electronically satisfy any legal requirement that they be in writing.

If you separately opt in to receive text messages, those messages are subject to the SMS terms in our Privacy Policy. You can reply STOP to any text message to opt out and HELP for help. Consent to receive marketing texts is not a condition of purchase. You can unsubscribe from marketing emails at any time using the link in the email.

13. Third-Party Services and Links

The Site relies on, and may link to, services operated by other companies, such as our website and CRM platform, payment processor, video and scheduling tools, retailers, and distributors. We do not control these third parties and are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their own terms.

14. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, COURSES, AND MATERIALS AVAILABLE THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

Any warranties for our publishing services are only those expressly stated in your Publishing Services Agreement. Some states do not allow certain warranty exclusions, so some of the above may not apply to you.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THARSOS PRESS AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, ROYALTIES, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US THROUGH THE SITE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) [LIABILITY CAP AMOUNT, E.G. $100].

Liability related to publishing services is governed by your Publishing Services Agreement. Some states do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Tharsos Press and its members, managers, employees, contractors, and agents from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the Site, (b) your Submissions, including any claim that your Submissions infringe or violate the rights of a third party, or (c) your violation of these Terms or any law. We will notify you of any such claim and may choose to participate in the defense with counsel of our choosing.

17. Governing Law and Dispute Resolution

Governing law. These Terms are governed by the laws of the State of Wyoming [CONFIRM GOVERNING LAW], without regard to its conflict of laws rules.

Informal resolution first. Before filing any claim, you and we agree to try to resolve the dispute informally. The party raising the dispute will send a written description of it to the other party (to us at [email protected] and 55 New St., Box 7 Suite I-3 Ephrata, PA 17522), and we will both try in good faith to resolve it within thirty (30) days.

If the dispute is not resolved informally, it will be resolved by final and binding arbitration administered by an arbitration provider (e.g. American Arbitration Association) under its applicable rules, before a single arbitrator, in Wyoming or by video conference. Either party may bring an individual claim in small claims court if it qualifies. Either party may seek temporary injunctive relief in court to protect intellectual property or confidential information. YOU AND WE AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.

If your Publishing Services Agreement contains its own dispute resolution terms, those terms control for disputes related to that agreement.

18. Termination

We may suspend or end your access to all or part of the Site, including the author portal or course, at any time if you violate these Terms or if we reasonably believe it is necessary to protect the Site, our business, or other users. You may stop using the Site at any time. Termination of your Site access does not by itself terminate a Publishing Services Agreement, which ends only as provided in that agreement.

Sections that by their nature should survive termination will survive, including those on intellectual property, payments owed, disclaimers, limitation of liability, indemnification, and dispute resolution.

19. Changes to These Terms

We may update these Terms from time to time. We will change the "Last updated" date above and, for significant changes, may give additional notice on the Site or by email. Changes take effect when posted. Your continued use of the Site after changes are posted means you accept the updated Terms. Changes will not apply retroactively to disputes that arose before the change.

20. General Provisions

·       Entire agreement. These Terms, our Privacy Policy, and any other terms presented at purchase are the entire agreement between you and us about the Site. Your Publishing Services Agreement governs our publishing services as described above.

·       Severability. If any part of these Terms is found unenforceable, the rest will remain in effect, and the unenforceable part will be enforced to the maximum extent permitted.

·       No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

·       Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets, or to an affiliate.

·       Force majeure. We are not responsible for delays or failures caused by events beyond our reasonable control.

·       Copyright concerns. If you believe content on the Site infringes your copyright, please send a notice to [COPYRIGHT AGENT NAME AND CONTACT] with enough detail for us to identify the work and the material in question.
